Dian, after 5,900 state contractors with pending obligations

The Directorate of National Taxes and Customs (Dian) announced the opening of days of collection and control, focused on the recovery of the portfolio of taxpayers with current contracts with the State.

According to the entity’s information sources, based on data analytics processes, it was identified that about 5,900 contractors have pending payment of their tax obligations, with a portfolio close to $1.5 billion.

As a result of the measurement, processing and analysis of the information, it was shown that, according to the economic activity carried out, about 70% of the debtor contractors’ portfolio is concentrated in sectors such as: Financial and insurance activities (41%), Information and communications (19%) and Wholesale and retail trade and repair of motor vehicles and motorcycles (10%).

(Tax collection exceeded the May goal by 114.9%).

With respect to the geographical area of ​​influence and taking into account the overdue portfolio, 85% of the debtor contractors are in the jurisdiction of the branch offices of Medellin (37%) and Bogota (15%), while 33% belongs to the Large Taxpayers Operational Directorate. For the latter case, 99% of the contractors classified as Large Taxpayers are concentrated in Antioquia (55%) and Bogotá (44%).

For the above, The Dian invites these taxpayers to catch up on their obligations, for which the entity is fully available to deliver the relevant information to facilitate the payment of said obligations, in addition to contacting in the next few days those who are in arrears and with whom the collection process is being advanced to guide them in the process to be carried out.

Regarding the control actions, a universe of taxpayers was determined, which according to the data analysis shows signs of inaccuracy. Consequently, a control day will be held in different cities of the country, especially aimed at verifying this and the fulfillment of the other formal and substantial obligations, specifically billing, information reporting and filing of declarations.

CONSEQUENCES FOR BREACH

It should be noted that failure to comply with tax obligations has tax consequences such as:

• Criminal complaint for omission of withholding agent.

• Complaint for non-collection or collection of VAT.

• Ignorance of costs and expenses for non-payment of social security.

This is how the non-consignment of the sums collected or withheld for withholding at the source, VAT and National Consumption Tax, within the two months following the term established by the national Government, constitutes the crime of omission of a withholding agent, which establishes a prison sentence of between 48 and 108 months and a fine equivalent to twice the amount not consigned without exceeding the equivalent of 1,020,000 UVT.

SHOCK PLAN AGAINST EVASION

The Dian continues to work in the fight against smuggling and tax evasion, during the first half of the year and as a result of these actions, a management collection of $15.7 billion was achieved.

This result corresponds to COP 12.8 trillion for effective income and COP 2.9 trillion for inspection management, which represents an accumulated percentage growth as of June 30 of 42.6%, compared to the first half of 2021.
