The Attorney General of the City of Buenos Aires challenged the conclusions of an expert report from the Airport Security Police (PSA) that was provided in the case in which alleged irregularities are being investigated in the use of the Facial Recognition System for Fugitives (SRPF) by part of the Buenos Aires government.
“I come to challenge the conclusions of the expert report made by the Airport Security Police at the request of the acting Court, reserving the right to expand this, in view of the particular circumstances of the case,” R.oque Matías Di Biase, lawyer of the Buenos Aires Attorney.
For the Public Prosecutor’s Office of Caba, “the conclusions reached in the expert report are seriously wrong and do not reflect in any way the complexity of the personal data analysis operations on which the Facial Recognition System is based. of Fugitives (SRFP), which is why I challenge it”.
on Thursday, andhe Center for Legal and Social Studies (Cels) issued a statement in which it reported that the Superior Court of Justice (TSJ) of Buenos Aires “decided to remove the judge who was intervening in the case in which the constitutionality of the SRFP is discussed (… ) after the result of an expert report revealed the illegal use of the facial recognition system in the city”.
The text highlighted that the dismissal occurred “barely two days after learning the result of an expert report that reveals the illegal use of the facial recognition system in the city” and that the challenge, rejected in previous instances, “had been requested by the Government” of Buenos Aires.
The result of the expert opinion was revealed yesterday by Télam in an article in which he reported the complaint filed by Judge Gallardo before the federal justice based in the City of Buenos Aires to investigate possible violations of the intelligence law.
The complaint was filed yesterday by the magistrate after the news of his apartment was known and fell, by lottery, before the federal court 4, in charge of Ariel Lijo.
The expert report carried out by the Airport Security Police “reports that 8,045 people who were loaded into the system are not in the Conarc and that number of court orders has not been accessed.”
“The management of personal data presents irregularities that have not yet been explained: the expert report detects a set of 356 records that were entered, searched and then deleted manually and, furthermore, that many of the actions do not have traceability due to the fact that they are carried out with generic users and it is not even possible to detect which of those users deleted the data”, it was indicated.
However, the Attorney General challenges the report, clarifying that this procedure does not imply “consenting to everything that has been done so far, which in the opinion of the Government of the City of Buenos Aires is null and void by virtue of the ruling of the Superior Court of Justice and dealing and, in
consequence, of measures that were not adopted by the natural judge”.
“We are facing a clear procedural error that is transferred to the plane of the results. To carry out a correct analysis it was not enough to only compare the data corresponding to the two extreme dates (…) but, for that same range of dates , it should have started from a single list that contained all the DNIs existing in the Conarc database, collected on a daily basis, which is the way in which they are made available to the public”, objects the Attorney General.
And in this sense, the opinion underlines: “serious deficiencies are noted regarding the technical procedures applied to prepare the report, which results, at least, in a distorted analysis and with clear signs of inconsistency regarding the data used”.
