HOLY SUNDAY. – The Second Collegiate Court of Santo Domingo Este and Norte sentenced a man to 20 years in prison for having sexually raped a one-year-old infant.
According to the file presented by the Public Ministry, the baby’s father reported that the accused, whom he left in charge of the child’s care, sexually raped the infant.
He stated that while he was workingreceived a call from the accused today, but when he answered the call, In the letter he hung up and then sent a message to the child’s mother, telling her that the infant, carelessly, left the house and fell in the yard, but that when he checked him there was blood on his private part, which is why The mother took him to the doctor, who upon examining him determined that he had been sexually abused.
The sentence was imposed on Jimmy Reinoso Paniagua, by the judges of the Second Collegiate Court, presided over by Judge Josefina Ubiera Guerrero, and are made up of judges Yury Cuevas de la Cruz and Ariella Cedano Núñez (members), for the acts committed to the detriment of the child, whose name is omitted to protect his identity.
During the trial, the Public Ministry, represented by the trial prosecutor Ana Basora, showed the court elements of expert evidence, procedural and documentary acts, which demonstrate the criminal responsibility of the convicted person.
The Public Ministry demonstrated that the defendant’s actions constitute a violation of articles 331 of the Dominican Penal Code, which classifies and punishes sexual rape; as well as articles 12, 15, 16, 18 and 396 literal b and c of Law 136-03, of the Code for the Protection of the Fundamental Rights of Children and Adolescents.
